RetailSpot SAS is a French company specialized in digital advertising. Our clients—particularly website and mobile app publishers—use us to select and display ads in their environments based on various criteria, such as your interests, location, device type, customer journey, and the content of the page visited.

  •  We do not process any sensitive or nominative personal data; we use pseudonymous identifiers;

  • We only process your personal data necessary for advertising personalization if you give us your consent (via banners set up by publishers);

  • We do not sell your personal data, and it is protected according to security standards in accordance with regulations.

On this page you will find all the details about how we operate and the different ways to assert your rights.

1. Who are we ?

RetailSpot ("we", "us", "our") is the publisher of an advertising monetization platform through the sale of placements (the "Platform", "the AdServer"). Through this platform, we provide buyers with exclusive access to premium-quality publisher inventory (i.e., the sites you visit and/or services you use) (our "Clients"). As an independent, publisher-focused Platform, we help them monetize their digital advertising inventory (our "Services") so that they can continue to offer content to their users ("Users", "you", "your"). Our technology collects information about Users to optimize the display and delivery of digital advertising for Users. This information is used to display advertising on the terminal, or any connected device, that you use, to personalize the advertising displayed, when you have authorized us to do so; To produce statistical reports and for analytical purposes, as explained below. The purpose of this Privacy Policy is to explain and inform you about the information we collect, the purposes for which it is collected, how we use this information, and the mechanisms in place to protect it. This Privacy Policy also details your rights and choices regarding how we collect and use information about you (“Personal Data”). This policy applies when we collect your data while you browse our Customers' websites and/or applications (including connected TVs).

RetailSpot participates in the IAB's "European Transparency & Consent Framework" and complies with its Specifications and Policies.

2. How do we collect data?

RetailSpot uses technologies such as cookies, tags, and SDKs for mobile phones to collect data and store it on the user's device. Cookies are small text files containing a string of characters, recorded by the browser and stored on the user's device. They allow us to recognize and remember the user's browser, preferences, and other information. The RetailSpot tag is a piece of code inserted into the source code of our Customers' websites. This tag allows them to access and manage our Services. An SDK, or Software Development Kit, is the software used by our Customers to integrate RetailSpot and our Services into their mobile applications (iOS and Android). Web beacons or invisible pixels are used to help our Customers understand how users interact with their website. Pixels are transparent images, iFrames, or Javascript, that are placed on a website. Their use allows the website to measure the actions of the visitor who opens the page containing the pixel.

3. What data do we process?

When you browse our Clients' websites, mobile sites, and/or use mobile applications or applications available on any other connected device (including connected TVs), we may collect the following data about you:

Your IP address;

Data contained in cookies, for example, your unique identifier linked to your browser (RetailSpot internal ID; universal identifier if applicable);

Technical information about your device: browser, operating system, screen size;

Information on the geolocation of the device accessing the website;

Pseudonymous identifier for audience segmentation (if the site uses this type of system);

Information on other identifiers assigned to the device (IDFA, AAID if mobile phone or smartphone);

Information on user activity with their device, including the web pages and mobile applications viewed or used.

For your information, as part of our Services, we do not collect any information that can directly identify you. We do not know who you are, nor what your name, address, place of work, date of birth, email address, or phone number are. We do not collect any sensitive information (such as your religious beliefs, political opinions, or health details). We do not create segments and therefore do not specifically target children under 16.

4. For what purposes and on what legal bases do we process Personal Data ?

a. Purposes

RetailSpot receives, collects, and processes Personal Data for the following purposes:

Store and/or access information on a device;

Select standard ads;

Select personalized ads;

Measure ad performance;

Develop and improve products;

Ensure security, prevent fraud, and debug;

Technically deliver ads or content;

Use precise geolocation data.

b. Legal bases

When we provide our Services as a data controller, i.e., when we alone determine the purposes and means of processing, we rely on either:

the User's consent, where required; or

our legitimate interest.

When we provide our Services as a data processor, we process Personal Data on behalf of our Clients and according to their instructions. Therefore, our Clients are responsible for establishing an appropriate legal basis for data processing. You can find this information in their privacy policies, which are available on their websites.

We use your personal data based on legitimate interest for the following purposes: We analyze statistical data to improve our services, detect technical issues, and optimize advertising monetization. In accordance with Article 6(1)(f) of the General Data Protection Regulation (GDPR), we process your personal data based on our legitimate interest, provided that this interest is not overridden by your fundamental rights and freedoms.

5. To whom can your Personal Data be transferred? Who can have access to it?

We may share information, such as Personal Data, with our subsidiaries and with third parties who provide us with services, such as hosting, internet access, or with requesting partners, third-party data providers, advertisers, or fraud prevention tool providers. Depending on the solution used and where permitted, we may also share data with business partners to deliver or improve our products and services.

 

We may also disclose information if:

we are required to do so under applicable national or international regulations;

we must comply with a valid and legitimate request or demand;

such disclosure is necessary to defend our rights and/or interests.

Finally, we may share your Personal Data and other affiliated information with any successor entity in the event of a merger, acquisition, sale of assets, bankruptcy, or other corporate change.

6. How long do we keep your data??

No personal data is stored on RetailSpot servers. The statistical and counting data we use to provide our Services is stored for up to 13 (thirteen) months.

7. Your rights under the GDPR

When we act as a data controller, you can exercise your rights directly with us. Please note, however, that we process Personal Data on behalf of our Clients, the publishers. In some cases, it may be more appropriate for you to exercise your rights directly with the appropriate publisher.

You can ask us at any time:

To confirm that your Personal Data is being processed and/or to provide you with a copy of your Personal Data;

To rectify your Personal Data that is incomplete or inaccurate;

To withdraw your consent;

To erase your Personal Data, for example, if it is being processed unlawfully or if you withdraw your consent;

To opt out of the processing of any data;

To restrict the processing of your Personal Data, (i) if it is inaccurate, (ii) if the processing is unlawful, (iii) if you require us to retain your information beyond the retention period for the purposes of a legal claim, or (iv) if you have objected to the processing of your Personal Data and the verification of the validity of our legitimate interests is pending;

To provide you with an electronic file containing your Personal Data, or to transmit your Personal Data to a third party, provided this is technically feasible.

Before sending us a request, please note and understand that we are unable to provide you with Personal Data linked to your identity and direct identification. You must provide us with your RetailSpot ID and/or mobile ID so that we can connect this information to the Personal Data linked to this ID. (See the dedicated section: How to find your advertising ID below.)

Your request should be sent to contact@retail-spot.io. The response time is one month. If permitted by applicable regulations, we may extend this time limit by an additional two months depending on the complexity and number of requests submitted. We will notify you and explain the reasons for such an extension. If we decline to respond to your request, we will provide you with the reasons.

If you consider that your rights have been violated under applicable data protection regulations, or following a refusal to respond to your request, you can file a complaint with your competent local authority (for example, the CNIL for France).

You can block the storage of cookies and access the list of cookies stored by your browser.

How to find your mobile ID:
  • If you are using an iOS system (IDFA): For iOS devices, Apple has made the advertising ID inaccessible to users by default, but it can be retrieved with third-party apps. Finding your Apple IDFA requires a third-party tool. There are a wide range of apps that can display a device's IDFA to users, including:

  • Adjust Insights by Adjust

  • Branch Device ID Finder by Branch

  • My Device Identifiers by Kochava

  • Singular Device Assist by Singular Labs

  • If you are using an Android system (AAID): For Android devices, open the Google Settings app on your device and click "Ads." Your AAID will be displayed at the bottom of the screen.

8. Your Rights Under the CCPA

This section of this Privacy Policy is intended solely to provide information required by California residents under the California Consumer Protection Act (CCPA).

When you browse our Clients' websites and/or use their applications on your devices, we may collect personal information, including through the use of cookies or other similar technologies.

CCPA Personal Information is defined by California law as information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, to California consumers or households.

In doing so, we act as a Service Provider, providing display, ad-serving, and real-time bidding services to our Clients.

For more information about the categories of CCPA Personal Information we collect, the sources from which this CCPA Personal Information is collected, the purposes for which it is collected, and with whom we may share it, please refer to the sections above.

If you are a California resident, the CCPA grants you several rights:

  • The right to request disclosure of CCPA Personal Information that a business collects, uses, shares, or sells about you.
    We are committed to ensuring that you understand what information we collect. For more information, please refer to the "What data do we process?" section above or contact us directly at contact@retail-spot.io.

  • The right to request deletion of your CCPA Personal Information.
    At your request, we will delete the CCPA Personal Information we have collected about you, except in situations where this information is necessary to: provide you with a product or service you have requested; perform a contract we have with you; maintain the functionality or security of our systems; comply with legal obligations; or use the information internally in ways that are compatible with the context in which you provided it to us, or that are reasonably related to your expectations based on your relationship with us.

  • The right to opt out of the sale of your CCPA Personal Information (Do Not Sell).
    Because we are only a service provider, we do not sell your personal information, so you must exercise your right directly with the publisher on whose behalf we process your personal information.

  • The right not to be discriminated against for exercising your CCPA rights. We are committed to providing you with control over your CCPA Personal Information. If you exercise any of these rights outlined in this section of the Privacy Policy, we will not discriminate against you. You will not be denied or charged different prices or rates for goods or services, or provided with a different level or quality of goods or services.

However, you may refuse and/or request the deletion of your personal information that we process on our own behalf by asking us directly.

9. Transfer of Personal Data outside the European Union

RetailSpot does not have any foreign subsidiaries or business partners located outside the European Union (EU) or the European Economic Area (EEA).

10. Opt-out and withdrawal of consent

You can opt out at any time by contacting contact@retail-spot.io.

You can also accept or refuse some or all cookies (for example, by blocking all third-party cookies) directly in your browser by adjusting your settings. 11. How we ensure the security of your data ?

To ensure and maintain the security of your Personal Data, we have implemented all technical and organizational measures at our disposal to prevent your data from being unintentionally or accidentally lost, used, modified, or made publicly available without your authorization.

Should such an event occur, we have implemented measures to respond quickly and inform you and the competent supervisory authority, if necessary.
